CLE Special Needs Trusts

PBI CLE – A comprehensive review of special needs trusts! Presentation will include the following topics:

Identify the types of special needs trusts and how to choose the most appropriate type

• trust funded with disabled beneficiary’s assets

• trust funded with third-party assets

• pooled trusts

• ABLE accounts

Identify the requirements of each type of trust and learn how to draft and administer special needs trusts

• selection of trustee

• the role of the corporate fiduciary in administering SNTs

• relationships with trustee

• creation

• operation

• taxes

• administrative issues

  • identifying situations where special needs trusts are helpful: personal injury settlements, divorce, estate and trust plans

• knowing when to establish a pooled trust through a nonprofit agency

• planning for care of disabled persons

• understanding the interplay between various government entities and special needs trusts: Pennsylvania Department of Human Services and special needs trusts (Medicaid), Social Security Administration and special needs trusts (SSI)

Identify when to use a special needs trust, including

o Personal injury settlements and verdicts

o Inheritances

o Estate planning

Describe potential solutions to common ethical issues, such as

o Conflicts between a trustee and a beneficiary

o Assessing capacity

o Attorney-client privilege when representing a trustee
